Terms of Service

1. About these Terms

hyve (“hyve”, “we”, “us”) is operated by Carl Kuntz, an individual trading as hyve, based in Sydney, Australia. These Terms of Service (“Terms”) govern your access to and use of the hyve website and related services (the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. What hyve does

hyve helps cafés and other venues (“Venues”) reward guests who post about them on TikTok. A Venue sets a reward. A guest posts a TikTok video mentioning the Venue and submits the post link on hyve. hyve checks that the post is public, tagged correctly, and stays up for the required period, and then makes the reward available to the guest to redeem at the Venue.

3. Eligibility

You must be at least 16 years old to create a hyve account. If you are under 18, you confirm that you have your parent or guardian's permission to use the Service. You must also meet TikTok's own minimum age and account requirements to submit a TikTok post through hyve.

4. Your account

You need an account to submit posts and redeem rewards. You are responsible for keeping your login details secure and for activity that happens under your account. Tell us straight away if you think someone else has accessed your account. Once your TikTok handle has been used for a verified submission, it is locked to your account to prevent abuse.

5. Submissions and verification

• You submit a link to a public TikTok post you made about a participating Venue.
• hyve checks the post shortly after submission and again after a waiting period, to confirm it is real, public, and still live.
• A given TikTok post can only be submitted once, and only by one account.
• We may reject or reverse a submission if the post is private, deleted, edited to remove the required mention, purchased, faked, or otherwise submitted in a way that doesn't reflect a genuine visit or post.
• Rewards are only issued once a submission has passed verification.

6. Rewards and redemption

Each Venue decides its own reward, redemption process, and any limits (for example, a monthly cap on rewards). hyve facilitates the connection and verification, but the Venue is responsible for honouring the reward. hyve is not responsible for a Venue's failure to provide a reward, and rewards have no cash value unless the Venue says otherwise.

7. Content you submit

You keep ownership of the TikTok content you post. By submitting a post link to hyve, you give us permission to access and display information about that post (such as its link, thumbnail, and public engagement data) within hyve and to Venues, for the purposes of verification, fulfilment, and reasonable promotional use of hyve and the Venue. You confirm you have the right to grant this permission and that your post complies with TikTok's own terms and community guidelines.

8. Acceptable use

You agree not to:

• submit fake, purchased, bot-generated, or misleading posts or engagement;
• use multiple accounts, or someone else's TikTok account, to claim rewards;
• try to interfere with, reverse engineer, or abuse the Service or its verification process;
• use the Service for any unlawful purpose.

We may suspend or close accounts that breach these Terms.

9. TikTok is a separate platform

hyve is not affiliated with, endorsed by, or sponsored by TikTok. Your use of TikTok is governed by TikTok's own terms and policies. We are not responsible for TikTok's availability, content moderation decisions, or changes to its platform, and these may affect your ability to submit or verify posts on hyve.

10. Disclaimers and liability

The Service is provided “as is”, without warranties of any kind. To the extent permitted by law, hyve is not liable for indirect, incidental, or consequential loss arising from your use of the Service, including loss connected to a Venue's reward or a TikTok post being removed, rejected, or delayed. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the “last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia.
